By accessing or using the EcoGuardian Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use our Services.

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services following such modifications constitutes your acceptance of the revised Terms.

2. User Accounts

Some features of our Services may require you to create an account. When you register for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify EcoGuardian of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

3. User Conduct

When using our Services, you agree not to:

• Use the Services for any illegal or unauthorized purpose

4. Intellectual Property Rights

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of EcoGuardian, our licensors, or other content suppliers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any content on our Services, except as follows:

• Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

5. User Content

Our Services may allow you to post, submit, publish, display, or transmit content or materials (collectively, "User Content"). By providing any User Content on the Services, you grant to EcoGuardian and our affiliates, licensees, and successors a worldwide, non-exclusive, royalty-free, fully paid, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any form, media, or technology now known or later developed.

You represent and warrant that:

• You own the User Content posted by you on or through the Services or otherwise have the right to grant the license set forth above
• Your User Content does not violate the privacy rights, publicity rights, copyrights, contractual rights, intellectual property rights, or any other rights of any person

6. Donations and Financial Contributions

EcoGuardian is a registered non-profit organization. When you make a donation or financial contribution to EcoGuardian, you agree that:

• All donations are final and non-refundable
• We will use your contribution to support our conservation programs and administrative costs
• We may acknowledge your donation publicly unless you specifically request anonymity
• For tax purposes, we will provide appropriate documentation for your contribution as required by law

7. Limitation of Liability

In no event will EcoGuardian, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services, any websites linked to it, any content on the Services or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

8. Indemnification

You agree to defend, indemnify, and hold harmless EcoGuardian, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

9. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the United States and the State of Oregon, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Oregon, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

10. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party, or us.

Upon termination, your right to use the Services will immediately cease. If your account is terminated, we may delete any content or data that you've submitted through the Services.

11. Miscellaneous

These Terms constitute the entire agreement between you and EcoGuardian regarding the Services and supersede all prior and contemporaneous written or oral agreements between you and EcoGuardian.

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms do not create any agency, partnership, joint venture, or employment relationship, and you do not have any authority of any kind to bind EcoGuardian in any respect whatsoever.
